Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to face human smuggling allegations, he was held in immigration detention.
In her decision, the court pointed out that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
